BACKGROUND:

On December 12, 2022, the Ocala Planning & Zoning Commission (first public hearing) considered a Concurrency Development Agreement to be entered into pursuant to Sections 163.3220 through 163.3243, inclusive, Florida Statutes, between the City of Ocala (City) and Shands Teaching Hospital and Clinics, Inc. The second and final public hearing is scheduled for Tuesday, December 20, 2022, at 4:00 pm with the Ocala City Council.

 

The property is approximately 28.2 acres located adjacent to the east side of I-75 with frontage on US 27 and NW 35th Avenue Road. (Parcels #21483-000-00, 21465-006-00, 21765-000-00, 21757-001-00, and 21757-000-00). The City held public meetings in December of 2021 approving the PD, Planned Development for the entirety of the project area. A traffic study was submitted and approved in conjunction with an approved site plan. The traffic study yielded some required improvements due to the impact of the development at the intersection of NW 35th Avenue Road and US 27. A proportionate share cost was determined in the amount of $348,570 and shall be required prior to the issuance of certificate of occupancies for the project. The Florida Statues requires two public hearings for a Chapter 163 Concurrency Development Agreement with the option of the first public hearing being with the Local Planning Agency (Planning and Zoning Commission). The development agreement is consistent with the findings of the approved traffic study and site plans.

 

FINDINGS AND CONCLUSIONS:

The Chapter 163 Concurrency Development Agreement addresses the results of the approved traffic study and site plans.

 

Staff recommend approval of the Chapter 163 Development Agreement.
