BACKGROUND:

The Florida Department of Transportation (FDOT) is prepared to undertake Financial Project ID 436361-1-52-01 for Marion County Intelligent Transportation Systems (ITS) Operational Support in accordance with its adopted five-year work program. The purpose of the project is to allow Marion County to improve arterial traffic management monitoring from the Marion County Traffic Management Center (TMC) and network redundancy along arterial corridors in the County.

 

This project includes the installation of fiber optic cable from the Marion County office of the County Engineer to the landfill tower in the Marion County solid waste facility. The cable will run south down SE 25th Avenue (within the City of Ocala’s right-of-way) from the Marion County Office of the County Engineer, east along SR 464, south down SR 35, then west along Laurel Road to the landfill tower in the Marion County solid waste facility.

 

FINDINGS AND CONCLUSIONS:

The Marion County TMC is located within the geographical boundaries of the City of Ocala (City). It will be necessary to install some portions of the transportation fiber optic cable and ITS devices within the City’s right-of-way (ROW) on SE 25th Avenue to reach the Marion County TMC facility.

 

This License Agreement is required by FDOT and grants permission to FDOT, its contractor, and representatives to undertake construction within the ROW on SE 25th Avenue. FDOT and the City will collaborate on the design of the systems to be constructed within the City’s ROW.

 

The attached Construction, Maintenance and Operations Agreement between FDOT and Marion County was executed on February 17, 2022.

 

Staff recommends approval of the License Agreement with FDOT.

RESOLUTION 2022-XX

 

A RESOLUTION TO APPROVE LICENSE AGREEMENT BETWEEN THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION AND THE CITY OF OCALA FOR THE INSTALLATION OF INTELLIGENT TRANSPORTATION SYSTEMS WITHIN THE SE 25TH AVENUE RIGHT OF WAY

 

WHEREAS, the State of Florida Legislature has approved and mandated the Florida Department of Transportation (DEPARTMENT) to complete the various projects included in the DEPARTMENT’S Work Program; and

 

WHEREAS, included in the DEPARTMENT’S Work Program is Intelligent Transportation Systems (ITS) Operational Support - Marion County CMGC Contract, Financial Project ID 436361-1-52-01 Federal: Funds #D521-028-B and #D521-058-B (hereinafter referred to as the Project). The purpose of the Project is to allow Marion County to improve arterial traffic management monitoring from the Marion County Traffic Management Center (TMC) and network redundancy along arterial corridors in the County; and

 

WHEREAS, the Marion County TMC is located within the geographical boundaries of the City of Ocala (CITY) and it will be necessary to install some portions of the transportation fiber optic cable and pull boxes within CITY’s right-of-way in order to reach the Marion County TMC facility; and

 

WHEREAS, the DEPARTMENT and CITY will collaborate on the design of the systems to be constructed within the CITY’S right-of-way; and

 

WHEREAS, the Parties hereto agree that it is in the best interest of the DEPARTMENT and CITY for the DEPARTMENT to complete all aspects of the Project not on the State Highway System, including, but not necessarily limited to: (1) constructing the Project through its completion, and (2) providing Construction Engineering Inspection (CEI) as necessary for the Project.

 

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session duly assembled that the City Council President is hereby authorized to make, execute and deliver to the State of Florida Department of Transportation the License Agreement for the project known as FPN# 436361-1-52-01.
