BACKGROUND:

The design of the Marion County Emerald Road Extension project encompasses portions of property owned by the City of Ocala (City) known as Perry Spray Field (Parcel 37517-000-00), located on the easterly side of SE 92nd Loop just east of SE Baseline Road.  The construction of the project will produce conflicts with the City’s spray field facilities which will need to be mitigated by being relocated or adjusted.  Portions of the City’s spray field will be required for right-of-way and easements for the construction or maintenance of the project.  The spray field facilities' relocations or adjustments will require engineered construction plans and subsequent construction efforts.

 

FINDINGS AND CONCLUSIONS:

Because of the benefits to be derived from the project, it is deemed to be in the public interest of both parties for Marion County to perform the project, and the City to perform, or contract, the work required to mitigate the City’s spray field facilities.  Marion County agreed to use a City-preferred appraisal firm to assess an all-inclusive cost for the property needed for the right-of-way and damages to the remaining City property resulting from the mitigation of the spray field facilities.

 

Staff recommends approval of the interlocal agreement with Marion County.

 

FISCAL IMPACT:

Marion County agrees to compensate the City an amount of $392,500 for 10.33 acres of property acquisition for the right-of-way; $177,080 for 4.66 acres of property acquisition for drainage retention areas; $2,750 for the total fee of the appraisal services; and an amount not to exceed $1,760,400 for the actual cost incurred for construction efforts associated with the spray field modifications.  An accompanying budget resolution is provided on this agenda to appropriate the construction portion of funding from Marion County.  Funding will be available for the construction costs in account 308-051-397-535-69-65010.

This Agreement has been reviewed by the Procurement and Contracting Officer and is

in compliance with City policy.
