BACKGROUND:
The State-Funded Grant Agreement (SFGA) FPN 435547-3-54-01 addresses the construction of the NW 44th Avenue Extension (Phase 2) Project from State Road 40 to NW 11th Street (0.8 miles), providing a new four-lane roadway with bike lanes and sidewalks on both sides.
Resolution 2023-25 was adopted by City Council on April 18, 2023, for the State-Funded Grant Agreement (SFGA) FPN 435547-3-54-01, accepting grant funds from the Florida Department of Transportation (FDOT) in the amount of $8,000,000 for the construction of the NW 44th Avenue Extension (Phase 2) Project. Construction plans and construction, engineering, and inspection (CEI) services for this project were performed by the City’s Engineering Department.
Budget Resolution 2023-135 was adopted on April 18, 2023, to appropriate $8,000,000 in grant funds from FDOT. An Agreement with FDOT for FPN 435547-3-54-01 was executed on May 30, 2023.
The project was completed on March 13, 2025, at a total cost of $5,785,270, including in-house CEI costs.
FINDINGS AND CONCLUSIONS:
In accordance with the approved legislative appropriation application, the City has committed 50 percent, or up to $8,000,000, to the project. The total cost of the NW 44th Avenue Extension (Phase 2) Project was $5,785,270; FDOT's participation amount was $2,892,635 (50 percent), and the City's match was $2,892,635 (50 percent). The City was reimbursed by FDOT for its participation share in the amount of $2,892,635 for the NW 44th Avenue Extension (Phase 2) Project.
The State-Funded Grant Supplemental Agreement No. 1 provides funding for additional projects, incorporates the City's match requirement as approved in the appropriation, and amends the Schedule of Financial Assistance and State Financial Assistance exhibits in the original SFGA executed on May 30, 2023. These amended exhibits provide a maximum award of state funds in the amount of $8,000,000, consisting of $2,892,635 in Fiscal Year 2022-23 and $5,107,365 in Fiscal Year 2025-26.
The awarded funds can now be used for the following projects:
1. Construction of NW 44th Avenue Extension (Phase 2) project (completed);
2. Four-lane widening of SW 43rd Court from SR 200 to SW 32nd Street (Phase 1B) project (completed); and
3. Installation of a new traffic signal at the intersection of SR 40 and NW/SW 46th Avenue (completed).
The above projects will improve roadway safety, connectivity, and capacity in southwest and northwest Ocala, thereby expanding and stimulating economic opportunities.
This Resolution is a necessary administrative and contractual requirement allowing the City to enter into the State-Funded Grant Supplemental Agreement No. 1 with FDOT.
City staff recommends approval of this State-Funded Grant Supplemental Agreement No. 1.
FISCAL IMPACT:
This Supplemental Agreement does not require any change to appropriation of funds or to the associated budget resolution approved by City Council on April 18, 2023.

RESOLUTION TO APPROVE THE STATE-FUNDED GRANT SUPPLEMENTAL AGREEMENT No. 1
BETWEEN THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION AND
THE CITY OF OCALA
WHEREAS, the State of Florida Department of Transportation and the City of Ocala desire to facilitate FPN 435547-3-54-01/02; and
WHEREAS, on April 18, 2023, City Council accepted the State-Funded Grant Agreement by Resolution 2023-25; and
WHEREAS, on May 30, 2023, City Council executed the State-Funded Grant Agreement for project FPN#435547-3-54-01; and
WHEREAS, the State-Funded Grant Supplemental Agreement No. 1 provides funding for additional projects, inputs the City match of 50 percent or maximum of $8,000,000, and the State of Florida Department of Transportation maximum participation of $8,000,000; and
WHEREAS, the grant funding will be used for the construction of the NW 44th Avenue Extension (Phase 2) project, the four-lane widening of SW 43rd Court from SR 200 to SW 32nd Street (Phase 1B) project, and the installation of a new traffic signal at the intersection of SR 40 and NW/SW 46th Avenue; and
WHEREAS, the State of Florida Department of Transportation has requested the City of Ocala to execute and deliver to the State of Florida Department of Transportation the State-Funded Grant Supplemental Agreement No. 1 for the aforementioned project FPN 435547-3-54-01/02.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, duly assembled in regular session that the City Council President is hereby authorized to make, execute and deliver to the State of Florida Department of Transportation the State Funded Grant Supplemental Agreement No. 1 for the project known as FPN 435547-3-54-01/02.
