BACKGROUND:

                     For parcels located in unincorporated Marion County seeking connection to municipal water or sewer service, the City of Ocala requires property owners to enter into an Annexation Agreement giving the City the authority to annex the land at the City’s discretion when legally possible.  The Annexation Agreement form has been amended over the years with City Council approval, most recently at the October 20, 2010, meeting by Resolution 2021-1.

                     Southern Impression Development is seeking approval from Marion County of a multifamily development plan for Parcels 23813-008-00 and 23813-009-00.  The parcels are located on the west side of SW 43rd Court just north of SW 36th Street, near Saddlewood Elementary School. 

                     The developer is seeking connection to City water and sewer services.  The developer objects to signing the standard form agreement because it requires compliance with all City of Ocala land development regulations.  They have provided the attached red-line of changes to narrow the focus of compliance to water and wastewater design criteria and procedures. 

                     Because the original form agreement was approved by Council, the proposed amendments should also be approved by Council. 

 

FINDINGS AND CONCLUSIONS:

The amendments to the Agreement do not substantively change the effect as the property will be developed within Marion County in accordance with its land development regulations.
