BACKGROUND:

The Florida Department of Transportation (FDOT) is prepared to undertake Financial Project Number (FPN) 450952-1-52-01 (Project) for maintenance resurfacing and minor improvements on State Road 40 (from South Pine Avenue/U.S. 441 to 25th Avenue), in accordance with its adopted five-year work program. This project aims to extend the existing roadway's service life by repaving all travel lanes on State Road 40 within the project limits.

 

The project scope includes roadway resurfacing, reconstructing curb ramps to meet Americans with Disabilities Act (ADA) criteria, signing and pavement marking, and replacing existing signal vehicle detection loops within FDOT’s right-of-way. The project also includes resurfacing within the City of Ocala (City) rights-of-way at various intersecting streets along State Road 40.

 

FINDINGS AND CONCLUSIONS:

FDOT will undertake and complete the construction of the Project's off-system components for the benefit of the City, including construction engineering inspection and post-design services that may be necessary for the Project. FDOT requires this Resolution and Off-System Construction and Maintenance Agreement and grants permission to FDOT, its contractor, and representatives to enter and construct improvements within City rights-of-way.

 

Staff recommends approval of the Off-System Construction and Maintenance Agreement with FDOT.

The Procurement and Contracting Officer has reviewed this Off-System Construction and Maintenance Agreement in compliance with City policy.

RESOLUTION 2025-20

 

RESOLUTION TO APPROVE THE OFF-SYSTEM CONSTRUCTION AND MAINTENANCE AGREEMENT BETWEEN THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION AND
THE CITY OF OCALA

 

WHEREAS, the State of Florida Legislature has approved and mandated the State of Florida Department of Transportation (Department) to complete the various projects included in the Department’s Work Program; and

WHEREAS, included in the Department’s Work Program is Financial Project Numbers (FPN) 450952-1-52-01, a project for maintenance resurfacing and minor improvements of State Road 40 (from South Pine Avenue/U.S. 441 to 25th Avenue), located in Marion County, Florida (the Project); and

 

WHEREAS, due to the direct impact of the Project on off-system roadways that are under the jurisdiction of the City of Ocala (City), it is necessary for the Department to enter onto the City’s roadways and to construct certain improvements to said roadways; and

 

WHEREAS, the Off-System Construction and Maintenance Agreement grants permission to the Department, its contractor, and representatives to enter and construct improvements within the City’s rights-of-way.

 

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session duly assembled in regular session that the City Council President is hereby authorized to make, execute and deliver to the State of Florida Department of Transportation the Off System Construction and Maintenance Agreement for the project known as FPN 450952-1-52-01.
