BACKGROUND:

Key Points:

The applicant is requesting to amend a Planned Development (PD) Plan and Standards Book that was originally approved in March 2023.  The proposed amendment refines the existing PD Plan and Standards Book without altering the overall development layout. The amendment introduces a more detailed site layout, including internal lot configuration, setbacks, and development standards. Modifications include the addition of one commercial lot and the conversion of a previously designated commercial lot into a stormwater retention area. Internal setbacks are now established and will apply to both residential and commercial lots, whereas prior standards only addressed external property boundaries.

The plan also identifies signage locations for residential areas in addition to previously approved commercial signage. The two residential phases, as well as all previously approved buffers and access points, remain unchanged. Updates to the PD Standards Book include the addition of a definition for ancillary structures permitted within the 100-foot height-restricted buffer, with a maximum height of 35-feet. The proposed changes do not increase the density or intensity of development, as maximum development allowances remain unchanged at 11.88-acres of commercial development and 750 new residential units.  Additionally, the amendments do not impact the previously approved level of service (LOS) analysis and remain consistent with the adopted Future Land Use Policy governing the subject property.

 

 

FINDINGS AND CONCLUSIONS:

                     The proposed amendment is consistent with the existing Low Intensity Future Land Use classification pursuant to Code of Ordinances Section 122-244 and is not anticipated to impact the approved Future Land Use Policy for the Winding Oaks PD.

                     The proposed development will be required to extend sewer services to this project. All other City utilities are available at this location, and no level of service issues have been identified for public facilities as a result of the zoning amendment. 

Staff recommends approval with conditions.

                     Access to lots within the PD are restricted to the internal road network.

                     The internal road network must be provided for each subdivision of the PD to ensure access to the lots created and interconnectivity between subdivisions. The internal road network shall adhere to the applicable requirements of the Land Development Regulations. Single-lot subdivisions are not permitted.

A RESOLUTION APPROVING AN AMENDMENT TO THE PLANNED DEVELOPMENT (PD) PLAN AND ASSOCIATED PD STANDARDS BOOK (TBMI PD) FOR CERTAIN PROPERTY LOCATED AT 3661 SW 60TH AVENUE AND 5800 SW 31ST STREET (PARCEL 23817-002-00 & 23817-002-02), APPROXIMATELY 61.4 ACRES (CASE NO. PD22-44929).

 

WHEREAS, TBMI II, LLC (the “applicant”) submitted a PD Plan (Case PD22-44929) for property located at 3661 SW 60th Avenue and 5800 SW 31st Street (parcel 23817-002-00  & 23817-002-02), approximately 61.4 acres to allow for the construction of 750 residential units and 11.88 acres of commercial lots, including landscape buffers along the perimeter of the site, signage, and building height restricted areas; and

 

WHEREAS, as an associated Ordinance 2023-41 amended the zoning map of the City of Ocala changing parcels 23817-002-00 & 23817-002-02 from NO ZONING, to PD, Planned Development; and

 

WHEREAS, the City Council adopted Resolution 2023-1 establishing the PD Plan and Standards for development for the construction of 750 residential units and 11.88 acres of commercial land

 

WHEREAS, the applicant submitted an amendment to PD Plan and Standards Book (Case PD22-44929) requesting to amend the internal lot configuration, the addition of setbacks for residential lots, the identification of signage locations within residential areas, and the inclusion of a definition for ancillary structures; and

 

WHEREAS, on April 13, 2026, the Planning and Zoning Commission recommended approval of the applicant’s request by a  vote

 

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session, as follows:

1.                     The City of Ocala does hereby approve the amended TBMI PD plan (Exhibit “A”) and PD standards book (Exhibit “B”).
