BACKGROUND:

The owner, Ocala 42nd Street Commercial, LLC and Ocala 42nd Street Residential, LLC, has submitted a request to amend the Amended and Restated Site and Concurrency Development Agreement Pursuant to Chapter 163, Florida Statutes (Grand Oaks Town Center PUD, f/k/a Stolen Hours PUD), dated April 2, 2013, as recorded in OR Book 5929, Page 1279.

The applicant submitted a Planned Development (PD) rezoning application in 2024, altering architectural standards and increasing density. City Council subsequently approved the PD rezoning, plan, and standards book in August 2024 with the condition that the Chapter 163 development agreement affecting the subject property be amended by August 20, 2025. If the provisions of this condition are not met, the PD rezoning will not take effect.

The proposed amendment includes:

1)                     Increasing the number of multi-family residential units from 474 to 528 dwelling units (480 apartments and 48 townhomes);

2)                     Increasing the height within Phase 2 to allow apartments to be up to four stories;

3)                     Updating the traffic information based upon the traffic study update (TIA25-0001) submitted on February 14, 2025;

4)                     Capping the current tolling for the agreement’s expiration to 48 months; and

5)                     The clean-up of several sections of the original amended agreement, including sections 3, 5, and 6 for clarity and consistency with current city policies.

 

FINDINGS AND CONCLUSIONS:

The requested amendments are consistent with the conditions requested by staff during the PD rezoning in August 2024.

Staff recommends approval.

Planning and Zoning Commission

Staff presented the amendment request to the Planning and Zoning Commission at the April 14, 2025, meeting. The Planning and Zoning Commission recommended approval to City Council with a six-to-zero vote.
