BACKGROUND:
Martin & Weiss, LLC, doing business as (dba) Mutiny Bar Ocala, has applied for the expansion of the sale of beer, wine, and liquor for on-premises consumption to include outdoor consumption within the approved sidewalk café area at 46 South Magnolia Avenue, Suite B (Parcel 2853-046-009).

• Police Presence: There have been 38 calls for service to this location in the past two years. Two were criminal in nature. Location report is attached.
Pursuant to Section 6-33(c)(11) and (12) of the City of Ocala Code of Ordinances, staff reviewed the information provided by OPD and determined that the incidents were not related to the operation of the proposed establishment, did not occur at the subject restaurant, and did not involve the unlawful sale or service of alcoholic beverages at the establishment. Therefore, the arrest history does not adversely affect staff’s position regarding the request under the applicable code criteria.
• Request: The purpose of this request is for approval of the expansion of an existing State 4COP alcohol permit to allow the sale of beer, wine, and liquor for on-premises consumption to include outdoor consumption within the approved sidewalk café area for Martin & Weiss, LLC, (dba) Mutiny Bar Ocala. The proposed hours of operation are 2 p.m. - 2 a.m., Sunday-Monday. (Code of Ordinances Section 6-5 limits the hours and times during which alcoholic and intoxicating beverages may be sold, consumed or served, or permitted to be served or consumed, in any place or on any premises defined as a business establishment as follows: for each day of the week except Sunday, between the hours of 7 a.m. and 2 a.m. the following days. On Sunday, Alcoholic beverages may be sold for consumption on the premises only, between the hours of 11 a.m. and 2 a.m. on Monday; and beer, ale, and wine may be sold in sealed containers for consumption off the premises only, between the hours of 7 a.m. on Sunday and 2 a.m. on Monday.)
• Staff Comments: Comments were requested from Growth Management, Police, and Fire Departments, and legal review by the City Attorney. No comments or objections were received.
FINDINGS AND CONCLUSIONS: This request is for a provisional location permit, subject to the applicant satisfying the requirements of the City’s Code of Ordinances Section 6-32(d) to obtain their appropriate state-issued license.
