BACKGROUND:
The Interlocal Agreement between the City of Ocala (City) and Marion County (County) addresses the following:
1. Transfer of portions of SW 38th Court, SW 38th Avenue, SW Third Street, and SW 40th Avenue between SW 40th Street and SR 40 (Road Segment #1) from the County to the City. Prior to transferring ownership to the City, the County agrees to resurface Road Segment #1. The County will be responsible for funding, design, permitting, inspection, and contract administration of this work. The transfer of Roadway Segment #1 shall become effective upon the County’s issuance of the notice of completion for resurfacing and transfer.
2. Transfer of SW 43rd Court from SR 200 to SW 32nd Place (Roadway Segment #2) from the County to the City. Roadway Segment #2 is part of the City’s SW/NW 44th Avenue four-lane corridor project that is currently under construction. The transfer of Roadway Segment #2 becomes effective upon full execution of this agreement.
3. Transfer of SW 40th Avenue from SW 43rd Street Road to the south boundary of the Executive Park plat (Roadway Segment #3) to the County. The City and the County are not in agreement of current ownership and maintenance responsibility for Roadway Segment #3. The transfer of Roadway Segment #3 becomes effective no later than three months after the effective date of the fully executed agreement.
4. Signalization of the intersection of SW 40th Avenue and SW 43rd Street Road by the County. The County agrees to construct a traffic signal at this intersection to city standards. The County will be responsible for funding, design, permitting, and contract administration of this work. Completion of the signalization project shall occur no later than 36 months after the effective date of the fully executed Interlocal Agreement. Upon completion and acceptance of signalization by the City, the City will own, maintain, and operate the signal and pedestrian improvements.
5. Signalization of the intersection of SW 40th Street and SW 43rd Court by the City. The County is currently updating the Preliminary Engineering Report for SW 38th /SW 40th Street, and the City will coordinate signalization with the County’s design consultant prior to construction of the signal. The City will be responsible for funding, design, permitting, and contract administration of this work. Completion of the signalization project shall occur before the construction of SW 38th / SW 40th Street improvements by the County. The City will own, maintain, and operate this new signal.
FINDINGS AND CONCLUSIONS:
• The transfer of ownership of roadways and signalization of intersections is expected to better serve the public, improve safety, and promote development.
• The City and the County shall record a deed or file new right of way maps pursuant to Section 337.29(3), Florida Statues.
• The agreement allows for a reasonable extension of time for completing improvements as agreed to by both parties.
