BACKGROUND:
The State of Florida Department of Transportation (FDOT) has constructed and maintains state roadways within the City of Ocala limits. The funding and standards for the maintenance of those roadways are set by the legislature.
The City of Ocala believes, and FDOT agrees, that some of these roadways are better maintained under the City's direction to meet citizens' expectations and standards of excellence in particular, east State Road 40 (Silver Springs Boulevard) from NE 25th Avenue east to NE 24th Street.
To continue maintenance of the specified section of roadway, the City must enter into a Highway Maintenance Memorandum of Agreement with FDOT, which includes a resolution authorizing the City Manager to execute the same.
FINDINGS AND CONCLUSIONS:
The State of Florida requires City Council to adopt a resolution authorizing the City Manager to execute the Memorandum of Agreement.
The Memorandum of Agreement will be approved by separate action of City Council.

The Highway Maintenance Memorandum of Agreement has been reviewed by the Procurement and Contracting Officer in compliance with City policy.

A RESOLUTION BY THE CITY OF OCALA, FLORIDA AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF OCALA AND THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE MAINTENANCE OF STATE ROAD RIGHTS-OF-WAY BY THE CITY AS SET FORTH HEREIN; SETTING FORTH AN EFFECTIVE DATE
Whereas, as part of the continual updating of the State of Florida Highway System, the State of Florida Department of Transportation, for the purpose of safety and functionality, has constructed roadway, roadside areas, and medians on that part of the State Highway System within the limits of the City of Ocala or adjacent to; and
Whereas, the City of Ocala acknowledges there is mutual benefit in effectively maintaining these areas and the City of Ocala is of the opinion said roadway, roadside areas and median strips should be attractively maintained to provide a high quality of life for Ocala’s citizens and visitors; and
Whereas, the City of Ocala and the State of Florida Department of Transportation recognize the need for entering into an agreement to designate the terms under which the City of Ocala shall maintain the section of State Road 40 (Silver Springs Boulevard) from NE 25th Avenue to NE 24th Street; and
Whereas, the State of Florida agrees to compensate the City for these maintenance services as outlined in the agreement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session duly assembled as follows:
1. The City Manager is authorized to execute the “Highway Maintenance Memorandum of Agreement Contract No.: ASX20-R0,” between the CITY OF OCALA and the FLORIDA DEPARTMENT OF TRANSPORTATION, and mutually agreed upon renewals, a copy of which is attached hereto and incorporated herein by reference.
2. This Resolution shall take effect immediately upon its adoption.
