• In 2009, a future land use policy restricting development on the property subject to this resolution was amended pursuant to Ordinance 2010-21 to allow up to 600,000 square feet of commercial development. The policy also required a Developer’s Agreement with a master plan to address architectural design standards, landscape and buffering standards with a minimum 50 foot landscape buffer on eastern boundary. The policy also required:
o Traffic study
o Access management plan
o Ground monument signs
o Requirements of airport zoning.
• In February 2022, TBMI requested an amendment to the future land use policy (FLUP22-44631), to allow mixed-use residential and commercial development consistent with the existing Low Intensity future land use designation. The adopted policy amendment (18.14) states that the maximum allowable intensity of the overall development plan shall not exceed the PM peak hour trips equivalent to the previous restriction of 600,000 square of commercial development.
• The future land use policy amendment was approved and adopted by City on July 28, 2022, by Ordinance 2022-62, after being reviewed by the Department of Economic Opportunity. The ordinance with the policy language is attached.
• The applicant is requesting to rezone the subject properties to PD, Planned Development, zoning as required by the future land use policy amendment.
• TBMI has submitted a PD plan for approval in conjunction with a rezoning to PD, Planned Development. The PD plan proposes 11.88 acres of commercial/residential and 49.52 acres of residential with approximately seven commercial parcels and one residential area that may be developed in two phases. The proposed configuration is required to be platted and each parcel will undergo site plan review.
• The Planning & Zoning Commission voted to approve the PD plan and standards book by a vote of 6 to 0 at the February 13, 2023, meeting.
• After the P&Z hearing the applicant met with residents of Timberwood and their representative. Subsequent to that meeting the applicant is proposing and requesting the following modifications to the PD plan and standards book:
1. Prohibit the construction of any habitable MF structures within the current 100’ building height setback adjacent to Timberwood. Other structures (garages, storage, etc.) may still be allowed, but no MF units will be within 100 feet.
2. Modify the fence on the 25’ buffer detail to be an opaque fence, design and material to be finalized in site plan review.
3. Enhanced sign design standards have been provided for commercial and residential signage. Additionally, no electronic message boards shall be permitted.
• The traffic study methodology was approved by City staff on February 14, 2023. The traffic study is underway the applicant’s traffic engineer and is required to be submitted within 45 days of methodology approval. The traffic study affirming that impacts are less than 600,000 square feet of commercial development and identifying required road improvements and proportionate share costs is required to be approved prior to issuance of the first site plan approval within the project.
FINDINGS AND CONCLUSIONS:
The PD plan is consistent with the adopted future land use policy 18.14 pursuant to Ordinance 2022-62 and land development regulations. The PD plan and design standards with required buffers and height limitations are compatible with the surrounding area.

A RESOLUTION APPROVING THE PLANNED DEVELOPMENT (PD) PLAN WITH ASSOCIATED PD STANDARDS (TBMI, PD) FOR CERTAIN PROPERTY OF APPROXIMATELY 61.4 ACRES LOCATED ON THE EAST SIDE OF SW 60TH AVENUE, BETWEEN SW 31ST STREET AND SW 38TH STREET (Case PD22-44929). IN THE CITY OF OCALA, MARION COUNTY, FLORIDA.
WHEREAS, on March 21, 2023, Ordinance 2023-41 zoning approximately 61.4 acres of property located on the east side of SW 60th Avenue, between SW 31st Street and SW 38th Street (“the Property”), as PD, Planned Development, was approved by City Council;
WHEREAS, the applicant (TBMI, LLC) submitted for review and approval a PD plan and associated PD Standards book (Case PD22-44929) for the Property;
WHEREAS, on February 13, 2023, the Planning and Zoning Commission recommended approval of the applicant’s request by a 6 to 0 vote;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session, as follows:
