BACKGROUND:

Staff requests approval of a Storm Sewer and Access Easement to the Florida Department of Transportation (FDOT) across the City-owned section of the FDOT haul road to Marion County Parcel #21818+000+00.  The road is a pathway that FDOT uses to remove debris from I-75; it is not used for public transportation.  In May of 2003, a portion of the haul road was conveyed to the City in support of the future construction of NW 37th Avenue.  Now, FDOT needs an easement across the conveyed area.  The easement will support FDOT’s I-75 Expansion Project.  The approval will permit FDOT to construct and maintain a below-ground storm sewer pipe for drainage from I-75 to FDOT’s water retention area located on Marion County Parcel #21818+000-00.  Please see the attached aerial views for clarification.

FINDINGS AND CONCLUSIONS:

A resolution is required to authorize the execution of the easement.  Staff from the Engineering Department have reviewed and accepted the easement, subject to the City Council’s approval.  Staff recommends approval.

RESOLUTION 2026-1

 

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA GRANTING AND AUTHORIZING EXECUTION OF A PERPETUAL STORM SEWER EASEMENT AND ACCESS EASEMENT TO THE STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION (FDOT) CONCERNING PROPERTY COMMONLY KNOWN AS PARCEL 802.01; DIRECTING THAT THE SIGNED RESOLUTION AND EASEMENT BE FORWARDED TO THE STATE OF FLORIDA; AND PROVIDING AN EFFECTIVE DATE.

 

 

WHEREAS, the State of Florida Department of Transportation (“FDOT”) proposes to construct or improve State Road No. I-75, Section No. 36210, F.P. No. 443624-1 / 452074-1, in Marion County, Florida; and

WHEREAS, it is necessary that FDOT construct, operate, and maintain a storm water pipeline below ground level in order to facilitate said construction or improvement of State Road No. I-75; and

WHEREAS, FDOT has made application to the City of Ocala, Florida for an easement across certain lands now owned by the City for the purpose of clearing, excavating, constructing, operating, and maintaining a stormwater pipeline below ground level, with all such fills, cuts, drains, ditches, and other incidents with which FDOT may deem necessary or convenient (“Easement”), and said request has been duly considered; and

WHEREAS, said Easement will not limit the City of Ocala, Florida’s ability to make future necessary roadway-related improvements in the Easement Area as the City deems necessary; and

WHEREAS, said Easement is for transportation purposes which are in the public or community interest, is for the public welfare, and in the best interests of the City of Ocala, Florida; and

Section 1. Adoption and Incorporation of Recitals.
The City Council of the City of Ocala, Florida adopts the above-outlined recitals and incorporates them herein as part and parcel of this resolution.

Section 2. Purpose and Authority for Resolution.
This resolution is adopted for the purpose of authorizing execution of the above-described Easement and subsequent amendments thereto with FDOT and is adopted pursuant to the authority granted by Chapters 166, 334 and 335, Florida Statutes.

Section 3. Designation of Signatory.
The City Council of the City of Ocala, Florida hereby designates the President of the City Council as the official who is authorized to sign the Easement and subsequent amendments thereto with the State of Florida Department of Transportation.

Section 4. Direction to Staff.
A certified copy of this Resolution shall be forwarded to the State of Florida Department of Transportation at 719 South Woodland Blvd., Deland, Florida, 32720-6834 along with the executed Easement.

Section 5. Effective Date of Resolution.
This resolution shall become effective immediately upon adoption.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OCALA, FLORIDA, in regular session duly assembled as follows:

 

Section 1. Adoption and Incorporation of Recitals.
The City Council of the City of Ocala, Florida adopts the above-outlined recitals and incorporates them herein as part and parcel of this resolution.

Section 2. Purpose and Authority for Resolution.
This resolution is adopted for the purpose of authorizing execution of the above-described Easement and subsequent amendments thereto with FDOT and is adopted pursuant to the authority granted by Chapters 166, 334 and 335, Florida Statutes.

Section 3. Designation of Signatory.
