body
BACKGROUND:
The primary objective of the Fairfield Village Sewer Expansion Project (the “Project”) was to design and construct a sanitary sewer system that will remove from service a package plant that services approximately 350 mixed use residential lots and a community center. The Project successfully reduces approximately 710 pounds of total nitrogen annually from the Rainbow Springs Basin Management Action Plan (BMAP) area. This area was considered impaired by the Florida Department of Environmental Protection (FDEP) because of the high nitrate levels at the springs.
On January 7, 2020, City Council approved the original grant agreement, LPS0030, between the City of Ocala and FDEP for eligible work performed for the Project between July 1, 2019 and September 30, 2020. On July 8, 2020, the parties executed a change order to extend the completion date to March 21, 2021, due to a COVID-19 Emergency Order.
On February 2, 2021, City Council approved Amendment No. 1 to the grant agreement extending the expiration date to September 30, 2022, due to materials delays and unresolved issues of assets and easements between the City and Sun Communities, Inc. On September 9, 2022, City Council approved Amendment No. 2 which further extended the expiration date to December 31, 2024, due to materials related delays.
All construction related to the grant was completed on February 8, 2022.
FINDINGS AND CONCLUSIONS:
Amendment No.3 to Grant Agreement No. LPS0030 adds documentation requirements for contractors, adds miscellaneous/other expenses to the costs eligible for reimbursement or matching requirements and revises the Grant Work Plan. All remaining terms and conditions of the grant agreement remain unchanged.
Staff recommends approval of Amendment No. 3 to Grant Agreement No. LPS0030 and seeks authorization for City Engineer, Sean Lanier, to sign this and any future amendments to Grant Agreement LPS0030 which have no fiscal impact.
FISCAL IMPACT:
This amendment does not augment the original fiscal impact.
PROCUREMENT REVIEW:
This Agreement has been reviewed in compliance with City policy.
LEGAL REVIEW:
This Agreement will be reviewed and approved for form and legality by City Attorney, William E. Sexton.
