BACKGROUND:

On December 7, 2021, City Council approved a Federally Funded Subaward and Grant Agreement (“Agreement H0572” or the “Agreement”) between the City of Ocala and the Florida Division of Emergency Management (FEMA).  This Agreement awards funds from the Federal Emergency Management Agency’s Hazard Mitigation Grant Program DR-4337-376-R to improve the drainage of a residential area located at boundaries northeast of 16th Avenue.

On February 6, 2024, City Council approved Modification Number One to the Subaward and Grant Agreement, which reinstated and extended the term through April 30, 2024.

The project included constructing a new detention pond at 1613 Northeast 16th Avenue.  The project also included elevating 475 feet of the adjacent road, Northeast 16th Avenue, to divert stormwater runoff to the new pond.  The project was completed on April 30, 2025.  Because construction costs exceeded the initial budget, the City requested a budget increase, and the Florida Department of Emergency Management recommended it to FEMA.  The City also requested a period of performance (POP) extension with the budget increase.

FINDINGS AND CONCLUSIONS:

Agreement H0572 was awarded for an initial term beginning February 1, 2022, and ending April 30, 2023. The Agreement term was then reinstated and extended to end April 30, 2024, with Modification Number One.  Modification Number Two reinstates and extends that term through December 31, 2026, and makes the following amendments to Agreement H0572:

•                     The Agreement is hereby reinstated and extended as though it had never expired.

•                     The agreement period is amended to begin February 1, 2022, and end December 31, 2026, unless terminated earlier in accordance with the provisions of the Agreement.

•                     The Agreement is amended to increase the Federal Funding by $164,178.75, for the maximum amount payable under the Agreement to $395,033.50.

•                     The Budget and Scope of Work are modified as set forth in the accompanying Second Revision to Attachment A.

Staff recommends the approval of Modification Number Two.  After approval, staff will proceed with the final closeout inspections to complete the final task of Grant Agreement No. H0572.

FISCAL IMPACT:

Funding in the amount of $230,855 was appropriated in Fiscal Year 2021-22. This agreement modification awards an additional $164,179 to be appropriated in account 158-050-330-538-69-65010 for a total award of $395,034.
