BACKGROUND:
• Petitioner and Property Owner: Z&T Partners, LLC
• Agent: Gray, Ackerman & Haines, P.A., Tim Haines
Key Points:
The applicant is requesting to rezone the northern 1.19-acre portion of parcel 23472-001-00 and all of parcel 23472-004-00 from R-3, Multi-Family Residential, to INST, Institutional.
Zoning and Land Use Factors for Consideration:
Parcel 23472-001-00
• This request only affects the northern 1.19 acres of the subject property.
• The property currently has split zoning consisting of B-2, Neighborhood Business and R-3, Multi-family Residential. The affected portion of the property is currently zoned R-3.
• The subject property was annexed into the City limits in 1975.
• In 2001, a multi-use complex was developed on the southern B-2 portion of the property, which is not affected by this request.
Parcel 23472-004-00
• The subject property was rezoned to the PUD-8 zoning district in the 1980s as part of the La Jolla PUD.
• In May 2006, the property was rezoned to R-3, Multi-family Residential zoning district.
• The existing single-family residence constructed in 1977 remains on the property. A single-family residence is a permitted accessory use in the INST, Institutional zoning when associated with a church/place of worship or school site.
• The property is landlocked and does not have frontage along SW 20th Street, future development must meet all applicable Land Development Regulations.
FINDINGS AND CONCLUSIONS:
• The proposed rezoning is consistent with the existing Neighborhood Future Land Use designation, pursuant to Section 122-244 of the Code of Ordinances, and is consistent with the surrounding area.
• Future development of the property must meet all applicable Land Development Regulations.
• The subject property is serviced by city utilities, and adequate public facilities exist to service any future development.
