• Request: 2APS - The purpose of this permit is to allow the sale of beer and wine for off-premises consumption for RaceTrac, Inc., d/b/a RaceTrac, located at 4040 W Silver Springs Blvd. The hours will be Monday - Sunday 24 hours. (Sec. 6-5 limits the hours and times during which alcoholic and intoxicating beverages may be sold, consumed or served, or permitted to be served or consumed, in any place or on any premises defined as a business establishment as follows: for each day of the week except Sunday, between the hours of 7 a.m. and 2 a.m. the following days. On Sunday, Alcoholic beverages may be sold for consumption on the premises only, between the hours of 11 a.m. on Sunday and 2 a.m. on Monday; and beer, ale, and wine may be sold in sealed containers for consumption off the premises only, between the hours of 7 a.m. on Sunday and 2 a.m. on Monday.) This permit request, if approved, will be a provisional permit in accordance with Chapter 6, Section 6-32, of the city’s code of ordinances for a period of one year, during which the applicant must have completed their state license consistent with the application for the license to become fully issued.

FINDINGS AND CONCLUSIONS:
Proximity to schools, churches, and daycare centers: No schools are within a 500’ radius. There are two churches within a 500’ radius of the subject property. Watula Baptist Church abuts the subject property along the western boundary, and St. Lewis Baptist Church is located on the north side of SR 40 across from the subject property.
Proximity to other Alcohol Beverage Establishments: The property was recently annexed into the City, which extended the City limits. One other alcohol location within the city limits is within a 500’ radius of the subject property.
