BACKGROUND: On April 19, 2022, the City Council approved a donation agreement with W.G. One Corp, and Country Green, LLP concerning the dedication of the right of way for SW 44th Avenue. The proposed amendment addresses changes to some of the legal descriptions in the prior agreement, a calculation of the fair market value of the right of way for title insurance, an update to the phasing of the road improvements, and language concerning entities executing the closing documents.
FINDINGS AND CONCLUSIONS: The proposed amendment is necessary to finalize the conveyance of the right of way to the City. Staff recommends approval of the amendment.
